So, I wonder if they’re ever going to pursue in their futile and silly crusade the, y’know, non-SA webcomic artist who actually made the comic, not just the people who spread it around by showing it in a forum. Durr, oops.

Even then, apparently the attorney got to the section about “Parody and Fair Use” and just kinda glossed over it. Maybe that was the night of some big kegger party back in “law school”.

I think the fact that Ubisoft considers Jade copyrighted material is basically an admission that she’s more “face” than anything else.

Wait… has anyone here ever seen that movie “Simone”?

I have seen the comic. I WORK for Ubisoft. It is true, the comic isn’t funny or especially entertaining. However it does make a good point that Jade is a product more than a real person … Overall, Ubi should think that “taking on” the whole internet isn’t even a remote possibility. If you start suing all vile images in the interweebz, i promise you will spend the rest of the millenia doing it …

We have not seen the image, however it is our understanding that it in some way also involves trademarked property belonging to Ubisoft.

“Such Image and misuse of the ASSASSIN’S CREED mark constitute trademark infringement, dilution, and unfair competition in violation of common law trademark rights, the Lanham Act, 15 U.S.C. §§1125(a) and 1125(c), and state law.”

Jade is a person – not part of the ‘intellectual property’ of the game. While the image may have been offensive to her, it certainly does not consitute trademark infringement.
