I don't know if Enix could win that suit because the fans would not be making any money off of it. Or, perhaps more accurately, I don't know why they would bother. A copyright suit is a suit to gain back the profits from the breach of copyright. No profits: no reason to sue. The fans should drop their balls, and just release the damn thing, and see what Enix is really willing to do. Also, a huge fan backlash could convince the company that this is a bad idea. On the other hand, they are still making money off Chrono Trigger (I just recently bought it for my DS, so I can see how Square might be concerned).
